The search is on for fast-growing, less susceptible and undemanding plant species. Accordingly, non-native species are increasingly being investigated for their suitability as energy crops. Non-native species such as Jerusalem artichoke<em>(Helianthus tuberosus<\/em>), Chinese reed<em>(Miscanthus spec.<\/em>) and knotweed<em>(Fallopia<\/em> \u201cIgniscum\u201d), which are considered invasive and can spread into natural habitats, are already being marketed as energy crops. The aim of the project was to investigate the current situation regarding the cultivation of potentially invasive energy plant species in Saxony-Anhalt, the stakeholders involved and the legal framework. As a result, it can be stated that alien energy plants are currently still very rarely cultivated in Saxony-Anhalt. Most varieties (Ignicsum, Miscanthus, Topinambur, Sorghum) are still in the research phase and do not achieve the yield of maize. This is why they are hardly used by farmers. However, interest in alternatives to maize will increase in the future, as the additional amendment to the EEG that came into force in 2012 stipulates that basic and raw material payments can only be made if no more than 60 percent maize and cereal grains are used. What is explosive is that there is no legal basis for restricting the spreading of non-native energy crops, as the Federal Nature Conservation Act (\u00a740) excludes agricultural and forestry operations from the ban on the deliberate spreading and marketing of non-native species. This makes it difficult for the responsible authorities (chambers of agriculture) to control the cultivation of energy crops from alien species. There is therefore a need for action to create a legal framework to control the cultivation of potentially invasive energy crop species.
